Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Log Off Club mobile application ("App") operated by Log Off Club Inc. ("Log Off Club," "we," "us," or "our"). By creating an account or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use Log Off Club. By using the App, you represent that you meet this age requirement.

You must have a device with biometric hardware (Face ID, Touch ID, or fingerprint sensor) with biometrics enrolled. Log Off Club requires biometric verification for all interactions and cannot be used without it.

2. Account Registration

• You must provide accurate and complete information when creating your account.
• One account per person. Each account must be associated with a unique phone number.
• You are responsible for maintaining the security of your account credentials.
• You must not share your account or allow others to access it.
• You must promptly notify us of any unauthorized use of your account.

3. Biometric Verification

Log Off Club's core feature is biometric verification of every interaction. By using the App, you consent to:

• Using your device's biometric authentication system (Face ID, Touch ID, fingerprint) to verify your identity before posting, commenting, liking, messaging, following, and other interactions.
• Understanding that biometric verification is processed entirely on your device. Log Off Club does not receive, store, or transmit your biometric data.
• Understanding that you cannot use the App without biometric verification enabled on your device.

4. Acceptable Use

You agree not to:

• Use bots, scripts, or automated tools to interact with the App
• Create fake accounts or impersonate another person
• Circumvent or attempt to bypass biometric verification
• Post content that misrepresents who created it
• Post manipulated or synthetic media that depicts real people doing or saying things they did not do or say
• Harass, bully, threaten, or intimidate other users
• Post content that is illegal, harmful, hateful, violent, sexually explicit involving minors, or that promotes self-harm
• Spam, advertise, or promote commercial products without authorization
• Reverse engineer, decompile, or disassemble the App
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the App for any illegal purpose

5. Your Content

Ownership: You retain ownership of the content you create and share on Log Off Club (posts, comments, messages, photos, videos, voice messages).

License: By posting content on Log Off Club, you grant us a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute your content solely for the purpose of operating and providing the App. This license ends when you delete your content or account.

Responsibility: You are solely responsible for the content you share. You represent that you have the right to share all content you post and that your content does not violate any third party's rights.

6. Content Moderation

We reserve the right to remove content that violates these Terms or our Community Guidelines. We may also suspend or terminate accounts that repeatedly violate our policies.

Users can report content and accounts that violate our guidelines. We review reports and take appropriate action.

7. Intellectual Property

The Log Off Club name, logo, design, and all software, features, and functionality of the App are owned by Log Off Club Inc. and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our intellectual property without written permission.

8. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the App, you consent to our data practices as described in the Privacy Policy.

9. Purchases and Payments

Log Off Club may offer in-app purchases, including products from our store. All purchases are processed through secure third-party payment processors (Stripe, Apple Pay, Google Pay). We do not store your payment card information. All sales are final unless otherwise stated. Refund requests should be directed to logoffclubcontact@gmail.com.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee the accuracy, completeness, or reliability of any content posted by users.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOG OFF CLUB INC., ITS FOUNDERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE APP, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM USER CONTENT OR INTERACTIONS.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless Log Off Club Inc. and its founders, officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: your use of the App; your content; your violation of these Terms; or your violation of any third party's rights.

13. Account Termination

• By You: You may delete your account at any time through the App settings. After a 30-day grace period, all your data will be permanently deleted.
• By Us: We may suspend or terminate your account at any time if you violate these Terms, our Community Guidelines, or for any other reason at our discretion. We will make reasonable efforts to notify you, except in cases involving safety, legal requirements, or severe violations.

14. Dispute Resolution

Any disputes arising from these Terms or your use of the App will be resolved through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring claims in small claims court. You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms in the App and updating the "Last updated" date. Your continued use of the App after changes constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the App and delete your account.

17. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Log Off Club regarding your use of the App.
