Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Log Off Club mobile application and website (the "Service") operated by Log Off Club ("we," "us," "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 18 years old to use the Service. By using it, you represent that you meet this age requirement. We may verify your age using device-OS age signals and the date-of-birth you provide at signup.
You must have a device with biometric hardware (Face ID, Touch ID, or fingerprint sensor) with biometrics enrolled. The Service requires biometric verification for interactions and cannot be used without it.
2. Account registration
- Provide accurate and complete information when creating your account.
- One account per person. Each account must be associated with a unique email and (where required) phone number.
- You are responsible for keeping your credentials secure and for all activity on your account.
- Do not share your account or allow others to access it.
- Notify us immediately of any unauthorized use.
3. Biometric verification
Every meaningful interaction on the Service requires biometric authentication on your own device. By using the Service, you understand and agree that:
- Your device's operating system performs the biometric check entirely within its secure enclave. We never receive your biometric template, raw camera input, or any cryptographic material derived from it — only a pass/fail signal.
- You cannot use the Service if you have not enrolled biometrics on your device or if biometrics fail repeatedly.
4. Acceptable use
You will not, and will not permit others to:
- Use bots, scripts, or automated tools to interact with the Service.
- Create fake or duplicate accounts, impersonate another person, or misrepresent your affiliation.
- Circumvent or attempt to bypass biometric verification or any security control.
- Post content that misrepresents who created it, including synthetic or manipulated media that depicts real people doing or saying things they did not do or say.
- Harass, bully, threaten, or intimidate other users.
- Post content that is illegal, hateful, violent, that sexually exploits or endangers minors, or that promotes self-harm.
- Spam, advertise, or promote commercial products without authorization.
- Reverse engineer, decompile, or disassemble the Service.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Use the Service for any illegal purpose.
Detailed standards are in our Community Guidelines, which form part of these Terms.
5. Your content
Ownership: You retain ownership of the content you create on the Service.
Licence to us: By posting content, you grant us a non-exclusive, worldwide, royalty-free, sub-licensable licence to host, store, reproduce, modify (only as needed for technical operation — e.g., re-encoding, resizing, generating thumbnails), display, and distribute your content within the Service for the purpose of operating, providing, and improving the Service. This licence ends when you delete the content or your account, except for: (i) backup copies for the 30-day rolling backup retention period, and (ii) cached copies retained briefly by content-delivery networks. The licence is personal to operating the Service — we do not licence your content to third parties for their use.
Your responsibility: You are solely responsible for the content you post. You represent that you have all necessary rights to share it and that it does not violate any third party's rights or applicable law.
6. Content moderation
How we moderate: We may, at our discretion, remove content, restrict visibility, suspend functionality, or terminate accounts that violate these Terms or our Community Guidelines. We use a combination of user reports, automated abuse detection, and human review.
Statement of reasons: When we remove your content or restrict your account, we will give you a clear statement explaining: (i) the rule that was violated, (ii) the factual basis (typically the URL or in-app location of the affected content), and (iii) how to appeal.
Appeal: You may appeal any moderation decision within 6 months by emailing logoffclubcontact@gmail.com with the subject "Appeal" and a description of why you believe the decision was wrong. We will review your appeal in good faith and respond within 30 days. The appeals process is free of charge.
Reporting: Anyone (account or no account) can report content at /report, and registered users can use the in-app report flow.
7. Intellectual property
The Log Off Club name, logo, design, and the software, features, and functionality of the Service are owned by us and protected by intellectual-property law. You may not copy, modify, distribute, or create derivative works based on them without written permission. Trademark inquiries: logoffclubcontact@gmail.com.
7.1 Copyright / DMCA
We respond to valid notices of copyright infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. §512) and equivalent laws in other jurisdictions. Send notices to dmca@thelogoffclub.com; for the full procedure, see /dmca.
Repeat-infringer policy: We will, in appropriate circumstances and at our sole discretion, terminate accounts of users who are repeat infringers of intellectual-property rights. Receiving multiple substantiated DMCA notices, or a single high-severity infringement, may result in account termination.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service you acknowledge our data practices as described in the Privacy Policy.
9. Purchases and payments
The Service may offer in-app purchases, including digital goods and physical products from our store. Purchases are processed by third-party payment processors (Stripe, Apple Pay, Google Pay); we do not store your payment-card information. Mandatory consumer-protection rules in your country (e.g. statutory withdrawal rights for EU consumers, the EU Consumer Rights Directive) apply on top of these Terms. 10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY LAW.
We do not endorse, guarantee, or assume responsibility for content posted by users. Nothing in this section limits any non-excludable rights you have under mandatory consumer-protection law.
11. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOG OFF CLUB AND ITS FOUNDERS, OFFICERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) USD $100. THIS LIMIT DOES NOT APPLY TO LIABILITY THAT CANNOT BE EXCLUDED BY LAW (E.G., LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, FRAUD, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED UNDER MANDATORY LAW IN YOUR JURISDICTION).
12. Indemnification
You agree to indemnify, defend, and hold harmless Log Off Club and its founders, officers, employees, and affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your content, your violation of these Terms, or your violation of any third party's rights — to the extent permitted by law in your jurisdiction.
13. Account termination
- By you: Delete your account at any time in Settings → Privacy & Data → Delete Account. After a 30-day grace period (during which you may sign back in to reactivate), all your personal data is permanently deleted from our active databases. Backup copies expire on the rolling 30-day schedule.
- By us: We may suspend or terminate your account if you violate these Terms or our Community Guidelines, if your continued use is unsafe to others, if required by law, or for material business reasons. Where lawful and not contrary to safety we will give you a statement of reasons (§6) and an opportunity to appeal.
14. Dispute resolution
Users in the United States: Any disputes arising from these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. Either party may bring claims in small-claims court. You waive the right to participate in a class action or class-wide arbitration. You may opt out of this arbitration clause within 30 days of first accepting these Terms by emailing logoffclubcontact@gmail.com with the subject "Arbitration opt-out".
Users elsewhere: Disputes will be resolved in the courts identified in §15 below, except where local law gives you the right to file in your country of residence (e.g., EU/UK consumers may file in their home country).
15. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws rules. Subject to §14, the courts of Ontario have exclusive jurisdiction, except that mandatory consumer-protection law in your country may give you the right to bring claims in your home jurisdiction.
16. Changes to these Terms
We may update these Terms. For material changes we will notify you in the Service and re-prompt for acceptance. Continued use after the effective date of an update constitutes acceptance.
17. Severability
If any provision is found unenforceable, the remaining provisions remain in full force and effect.
18. Single point of contact
For purposes of any law that requires us to designate a point of contact (including the EU Digital Services Act Art. 11 if and when it applies to us): logoffclubcontact@gmail.com for users; logoffclubcontact@gmail.com for competent authorities. Communications may be in English or French.
19. Entire agreement
These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Log Off Club regarding the Service.
